Information & Privacy
We will collect personal information from you in the course of providing legal services. We may also obtain information from third party searches, other investigations and, sometimes, from other parties.
We are required to collect the full name and address of our legal service clients by Rule 93 of the Uniform General Rules. Accurate name and address information must also be collected in order to comply with the duty we owe to the court as lawyers.
Your personal information will only be used for the purposes for which it is collected, in accordance with the Privacy Act 1988 (Cth), and other law. For example, we may use your personal information to provide advice and recommendations that take account your personal circumstances.
If you do not provide us with the full name and address information required by law when asked, we cannot act for you. If you do not provide us with the other personal information that we request our advice may be wrong or misleading.
Depending on the nature of the case, the types of organisations to whom we may disclose your personal information include: courts, tribunals, the other party or parties to litigation, experts, barristers or third parties involved in the completion or processing of a transaction.
Sending Material Electronically
We are able to send and receive documents electronically. However, that transmission may not be secure and it may be copied, recorded, read or subject to interference by third parties while in transit.
If we are required to transmit any document to carry out your instructions, you release us from any claim you may have as a result of the unauthorised copying, recording, reading or interference with that document, or for any delay or non-delivery of any document, or for any damage caused to your system or any files.
Retention of records and documents
We may retain your documents while there is money owing to us for costs (see information about ‘liens’ in our General Terms & Conditions).
On completion of work, or following termination (by either party) of our legal services, we will retain your documents for 7 years.
You authorise us to destroy the retained file after 7 years by accepting the Terms and Conditions attached to our offer to provide legal or related services to you.
That authority does not relate to any documents deposited in safe custody by agreement between us. Safe custody items will either be returned or retained indefinitely.
